The boarder carries the Ultimate liability there, at least in the US the downhill person always has right of way....

The instructor should teaching these bad habits either. I always stop and tell the instructors around here that they should not be teaching bad habits of hanging under blind rollers, cutting all the way across piste immediately and blindly, lining up across the run blocking with 6-8 people side to side....
