By the way, Supreme Court did not rule corporations are people. They ruled corporations have 1st amendment rights. Huge difference. Corporations cannot vote or donate to campaigns. Two things "people" can do. OH snap, this is not the PoFo, so I'll get back on topic.

In the early 2000′s United Park repeatedly and categorically told the Utah State Tax Commission that PCMR’s Leases would not expire until 2051 and that PCMR had the right to occupy the property until then. Based on these statements, the Tax Commission reduced the assessed value of the property by more than two-thirds. Having enjoyed the benefit of reduced property taxes resulting from these representations, UPCM and Talisker shouldn’t be allowed to change their position now.
I know the lawsuit will hinge on more than this one fact, but if true, this is one point PCMR can argue for estoppel. Detrimental reliance.

I plan to visit Canyons and PCMR this coming year. Don't think it'll affect those plans in anyway though.

killclimbz Seems that the Ski link and Talisker screwing PCMR over is all part of Talisker's plan to reap profits off of raping the Wasatch. Well interconnected.

Andrew McClean did a tour of the proposed route for the Ski link Gondola, Cable care, whatever it's going to be.

The snowboarding forum thread we have discussing ski link.

I kind of get the attractiveness of being able to go to whatever resort in the Salt Lake metro from one location. The reality is, how much terrain do you really think you'll be able to ride in a day? Not very much of it. It's a gimmick, and what it will do is raise pass and lift ticket costs in the long run. Don't kid yourself, that is what will happen.

Khao I can't see the resort completely ignoring the end of their lease unless they have the most inefficient and lousiest legal team ever. It'd be my best guess that Talisker decided they wanted more money, Park City refused, so they've found some bullshit way to terminate the agreement. But who knowss

Cases like this rarely go to court. Both parties will protect their interests and negotiate. In a few months time, you'd have never known there was a disagreement.

2813308004 You guys have to realize the suit will likely settle out of court because the alternative means closing at worst acquisition by Talisker.

I think that the suit is a bargaining tactic to lower the rent because of venue concerns (where the case will be held)- beloved PCMR will be fighting a greedy Canadian real-estate conglomerate in Utah courts? PCMR seems to have an upper hand unless it's taken to a Federal Court and even then it's an American resort vs. a foreign company which means it'll still be an uphill battle for Talisker.

When you look at the implied assurances and manifestations of Talisker it's even more likely they'll be estopped from rejecting the renewing/extending of PCMR's lease.

In other words, don't worry... it will likely work out.

Pretty much this. Lease termination dates are pretty straightforward. Don't know how they've managed to fuck it up so I imagine it's going to be quite one sided. I can see Talisker pulling out some legal loophole however (and there a thousands when it comes to land law unfortunately).
